Introduction

This online store (e-shop) is operated by the Municipal Enterprise of Patras – Patras Carnival (KEDIP), within the framework of the project “Shadows and Masks – Center of Tradition and Culture.” These Terms of Use define the rights and obligations of both KEDIP and the visitors/customers of the e-shop. By browsing and/or using the e-shop, you unreservedly accept these terms. The website [www.skiemaskes.gr] also serves as the online store for the sale of products and services (hereinafter referred to as the “online store” or the “website”), created and operated by the Municipal Enterprise of Patras – Patras Carnival (KEDIP), headquartered in Patras (84 Akti Dymaion St., P.C. 26222), legally represented, VAT number 997992855, Patras Tax Office, email: info@carnivalpatras.gr, customer service line: +30 2610 390915. For brevity, it will hereafter be referred to as “KEDIP”.

Provided Information & Products

KEDIP – Patras Carnival guarantees the accuracy, truth, and completeness of the information listed in the online store, concerning both its identity and the transactions offered through it. In good faith, KEDIP shall not be held liable for electronic data entries made by mistake/oversight and reserves the right to correct them whenever detected. Please note that product photos displayed are for customer convenience and may slightly differ from the final delivered product. Such minor deviations do not alter the nature or essential characteristics of the products as described.

Limitation of Liability

KEDIP shall not be held responsible for damages resulting from the cancellation or delay of orders caused by force majeure or extraordinary events. KEDIP does not guarantee continuous product availability but undertakes to inform the customer in case of stock shortage. The e-shop provides information, services, and products “as is,” and KEDIP shall not be liable for any direct or consequential damages arising from their use.

Transfer of Risk

The risk of loss or damage to goods passes to the customer once they, or a third party authorized by them, physically acquire the products. If the carrier was chosen by the customer and not by KEDIP, the risk is transferred to the customer upon delivery of the goods to the carrier.

Intellectual Property Rights

All content of the online store, including trademarks, logos, images, graphics, photographs, designs, and texts, is the intellectual property of KEDIP and is protected by Greek, European, and international copyright laws. Any copying, reproduction, distribution, or derivative work based on this content, as well as any misleading use regarding the provider of the online store, is strictly prohibited.
Reproduction, republication, uploading, announcement, dissemination, transmission, or any other use of the content, in any manner or by any means, for commercial or other purposes, is only allowed with prior written consent from KEDIP or other rightful owners. Names, logos, and distinctive marks belong to KEDIP or third parties, respectively, and are legally protected. Their appearance on the online store does not grant any license or right of use to third parties.

User Responsibility

The user/customer agrees to use the services, information, and data of the online store in accordance with the law, good faith, and business ethics. It is prohibited to use the online store for:

  1. Sending, publishing, or transmitting illegal content that harms KEDIP or any third party, or infringes confidentiality.
  2. Publishing or transmitting content that offends morality, social values, or minors.
  3. Sharing content without having the legal right to transmit (e.g., insider information, confidential data covered by agreements).
  4. Violating third-party patents, trademarks, copyrights, or other proprietary rights.
  5. Uploading material containing viruses, malware, or harmful code.
  6. Any violation of applicable law or regulations.
  7. Harassing third parties in any way.
  8. Collecting or storing personal data of other users without legal basis, contrary to data protection legislation.

Return Policy

Product returns shall be accepted solely following prior telephone communication or by sending an e-mail to info@carnivalpatras.gr. As a customer, you are entitled to exercise your right of withdrawal, whereby you have a period of fourteen (14) calendar days to return the product purchased, for any reason whatsoever, including without cause, and to request either a replacement or a refund. The withdrawal period shall expire fourteen (14) days from the date of receipt of the products. In the event that the expiry of the withdrawal period coincides with a public holiday, the deadline shall be extended to the next working day. Any returned product must be accompanied by the relevant proof of purchase (Retail Sales Receipt). Returns shall be accepted only provided that the products to be returned are in exactly the same condition as when originally received.

Should you opt for a refund, the amount corresponding to your order, namely the cost of the products, shall be credited to you. Upon receipt of the returned product, we shall contact you to inform you regarding the status and progress of your request.

Refunds

Refunds shall be effected within fourteen (14) days from the receipt of the cancellation request. However, the refund process may be delayed if the products or proof of their return have not been received, and shall be carried out using the same method of payment as that of the original transaction. In the case of payment by cash on delivery or bank transfer, the refund shall be made to the bank account of the individual who placed the order. In the case of payment by card, the refund shall be made by reversing the transaction. In such an instance, the refunded amount shall appear as a credit on the card used for the payment. The refunded amount shall also include the shipping costs paid at the time of purchase, as well as the cash-on-delivery fee, if the payment method chosen was cash on delivery.

Collection and Use of Personal Data

In order to conduct any transaction through the online store of KEDIP – Patras Carnival and to complete product orders, it is necessary for the customer to provide certain personal information.

When placing an order, the following details shall be requested:

  • Full name,
  • Shipping address of the products,
  • Billing address (if different),
  • Invoicing details (if an invoice is requested),
  • A contact telephone number, and
  • An e-mail address.

In the case of payment by credit card or through an electronic payment provider (e.g., PayPal), the transaction shall be carried out directly by the customer via the secure environment of the respective provider, without KEDIP retaining any card details.

KEDIP shall use the information you provide for the following purposes:

  1. For the delivery of your order,
  2. For confirmation and identification of the customer,
  3. For communication regarding the product or service you have ordered,
  4. For information on new or related products/activities of the project “Shadows and Masks,”
  5. For confirmation of receipt.

The customer may choose whether to receive such communications by submitting a relevant request to the following e-mail address: info@carnivalpatras.gr.

By disclosing personal data, you consent to their use by authorized employees of KEDIP solely for the purposes outlined above. Under no circumstances shall such data be disclosed to third parties without your consent, unless required by law or pursuant to a court order (e.g., cooperation with law enforcement authorities or the prevention of unlawful activities).

User Rights

Users who have disclosed their personal data to KEDIP – Patras Carnival are entitled to the following rights in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679):

  • Right of access: to obtain confirmation as to whether and which personal data concerning you are being processed.
  • Right to rectification: to request the correction or completion of inaccurate or incomplete data.
  • Right to erasure (“right to be forgotten”): to request the deletion of your data where there is no lawful ground for their retention.
  • Right to restriction of processing: in cases where the accuracy or lawfulness of the processing is contested.
  • Right to object: to object to the processing of your data, in particular for purposes of direct marketing.
  • Right to data portability: to request the transfer of your data to another data controller.
  • Right to withdraw consent: where processing is based on consent, such consent may be withdrawn at any time without retroactive effect.

In addition, you have the right to seek interim judicial protection or to lodge a complaint with the Hellenic Data Protection Authority.
